The US Federal Communications Commission (FCC) has cited a major technology retailer for marketing unauthorized radio frequency (RF) equipment.

New York-based B&H Foto & Electronics has marketed seven different RF devices, according to the FCC’s citation and order. The special equipment listed in the citation: 1) does not use a permanently attached antenna or an antenna that uses a special connector; 2) lack of device license, as well as appropriate labeling and user manual descriptions; and 3) operating in bands that are not authorized by the equipment certifications and/or capable of operating outside the FM frequency band.

B&H was first informed of the matter in a letter of inquiry (LOI) issued in late 2020, following a referral by the Commission’s Spectrum Enforcement Division. In its response to the LOI, the company admitted that it had sold RF equipment based on false assurances from the equipment manufacturer that the equipment was not required to be tested and licensed. Upon further investigation, B&H stopped marketing that device shortly after receiving the LOI.

B&H also announced that it has conducted additional testing on six additional RF devices that the company has been marketing. Following communication with the manufacturers of the devices, it has stopped marketing the two RF devices. But it has issued valid FCC labels for four devices and continues to market those devices even though they can operate outside the FM frequency band.

In the citation and order, the FCC found B&H violated FCC rules by using marketing devices that could operate outside the scope of their respective device licenses. The citation and order give the company 30 days to provide written confirmation to the FCC that it has marketed the non-compliant RF equipment in question.
